Here's the background. You're a senior E5. Your troops are in formation and you're handing out work for the day. You hand out an assignment to a fresh E2 with less than a year in and only a few months at your command. They blatantly complain and tell you to choose someone else. You calmly tell them they will do this task and they tell you to shove it and give it to someone else. How do you react?

Well, the fact that this PVT has decided to mouth off to you in front of his peers shows he has no respect for you, for what ever reason, hopefully not because you are friends in anyway with your subordinates. I have sen a lot of E5,s remain friends with their E4 counterparts, its a no win no win situation, beyond CPL one of the hardest ranks because you must separate from your friends, at least until they make the grade. I was mouthed off to by an E4P that thought because he was promotable he outranked me as a non-promotable CPL, NOT. If a Soldier wants to mouth off in public, smoke that ass right there and have him remain in the lean and rest until you dismiss everyone else and follow up the corrective discussion with written counseling, you may have to resort to an Article 15 down the road with that brain surgeon. If you do nothing, or wait, you will be weakened in the eyes of those that were witness, you will have just flushed your stripes down the toilet. You never let anyone talk down to you if you are an NCO, not higher or lower, if you do, you will never have the trust and respect of those Soldiers you are to lead.

give him more assignments and give him a rediculous amount of knowledge to learn for the next morning. Test his knowledge after pt and if he doesnt know something, slay his ass

Excuse me Top, I will have a Counselling Statement to you by this afternoon, this young Soldier states that he is not going to do the work assigned to him. Priate NoWork, you and I will be doing the Whole Squads work today. By we I mean you while I Supervise, and write this counselling. Turn the counselling into my Platoon Sgt to revue, and have the Private sign the Counselling and hand deliver it to the 1SGT. Thank you for your time. SGT(E5) retired Marcus Mason

For whatever reason,I had never run into this issue. That being said, I was known for hard drinking and absolutely no BS!. I had a pick named "attitude", and a shovel named "adjustment", and with them I filed out "CONCURRENT TRAINING" on the digging of a proper military fighting position, and ensured to remain environmentally conscious to make him fill it back in so as not to violate the environment. I know what you're thinking , and yes I am ECO FRIENDLY!!

When I was in you were no longer allowed to hit a soldier unless they showed aggression first. Have the soldier remain behind with his team leader inform him where his attitude will lead him. Give him a month extra duty, make sure the counseling is recorded and recommend a talk with the chaplain. Afterwards talk to team leader about soldier privately.

Excuse me Sir but the situation that we are responding to says that "YOU" are the Senior E5. It is your responsibility to deal with the soldier.

That's fine. I would sort him out then. I had this happen a couple of times even as an officer with a senior NCO and later a senior warrant doing the same thing. I counseled them. If you have the rank you've got to deal with it.

It's happened to me before. What I want to do isn't what I should do. We should be able to go blow for blow in the tool room until I show them who's in charge. Now days you have to bow out or they will complain to the upper echelon and then you get reprimanded. I would now tell them if they didn't do it, I would write them up. That's all you can do. Make a paper trail. It really goes nowhere so this is indefinitely ineffective. It's all bullshit really

The paper trail will only not be effective if you let it be. You can't just paper them and then forget about it. I had a soldier that all anyone would do was paper them and roll on. You have to follow it up yourself.

The proper manner to handle such a situation, would be to have the trooper understand that while wearing this uniform, legal requests are to be obeyed and followed through. That only through team work and unity can the company complete its mission. This is part of the oath the soldier took when he or she was sworn in.
