Here's the background. You're a senior E5. Your troops are in formation and you're handing out work for the day. You hand out an assignment to a fresh E2 with less than a year in and only a few months at your command. They blatantly complain and tell you to choose someone else. You calmly tell them they will do this task and they tell you to shove it and give it to someone else. How do you react?

Bottom line up front - I would dismiss my formation WITHOUT tasking anyone else, and tell the troop to stand fast. He/she will have 30 seconds to explain why they told me to shove it, just in case they had a brain to mouth misfire. I do not care if there is any personal issue happening with the troop, one does not address an NCO in that manner, in front of other soldiers, and that at a minimum, a summarized art 15 will be recommended. If the troop is having a serious issue, the Summarized can be suspended, provided another incident like this does not happen again. If the troop is just being defiant, well, that recommendation will upgraded to a company grade at a minimum, and I would seek advice from the PSG, who would probably want to speak with the troop as well. It is one thing to find out what is going on with your Soldier, quite another to allow that Soldier to openly and brazenly disobey an order, with such a blatant disregard for decorum. We all have bad days, I get it, but there is a right way and a wrong way, and this is beyond just being the wrong way.

When I was a young Corporal, I put a Marine on the ground who did that. I got in quite a bit of trouble. My platoon sergeant GySgt Melton called me into his office, ripped me a new one and told me not to do that where others could see it. ;-)

Keep in mind this is 2021 and a different military. That E5 will have to get in touch with his Mom and ask permission to rectify this problem

don't know what could have taken place during my time in the Army 67. But refusing an order? nobody in my Company was that foolish

Back in the day I would probably have looked at him in a cold and calm manner, then said something along these lines: "Seaman Staines, you are obviously operating under the false belief that obeying the lawful order of a Petty Officer in the United States Navy is an optional affair. This is your work assignment and you will complete it to the best of your ability in a timely manner or you will suffer the consequences. Now shut your face before I kick a mud hole in your ass and stomp it dry."

Now that I am a man of God, I would simply advise him to give his soul to Jesus because his butt belongs to me, and then proceed to make his day very unpleasant; all the while praying for his sorry soul.

I would suspect that basic training and AIT aren’t what they used to be for this to happen. But remember that the boss has no friends and too much socializing with subordinates can undermine your authority as well. Some private individual counseling is called for to make sure there are no extenuating circumstances, but then a good ass chewing is probably in order. I really had no problem with the DI’s as my old man was tougher on me than they ever thought of being.

Times have certainly changed since I was in 50 years ago. At that time you would do fifty push ups, taken out behind the barracks and get an ass kicking. After that would be K P and every crap detail for a month. Sure seemed to work.

I have been in this situation as an E-5 to a Buck Pvt. He told He didn't want to do something. I stopped and turned around and told Him I don't remember asking you. Now if you don't want to clean all the latrines in the barracks get the task done which He did.

Introduce him to my favorite NCO and Officer (SGM Miranda and Major Rights) they tend to have a sobering reaction to those questioning little tykes. Be sure to play the song by Archie Bell and the Drells....The tighten-up!!!!!

Crush it publicly and forever. If you have people to spare put someone else on the mission, change to pts and smoke him all day. Let the rest of the unit see you crush him. They should all day, "there but by the grace of God, go I."

Tell him that out of respect for a 1st Lieutenant, and the NCO that instructed him to perform the task he will compmply or he will suffer disciplinary action, not shy of Article 15.

Ok... their is no more close door counselling so thats out the way...complete what your doing that will give you time to process what just happen . As a NCO you should know your solders who is a dirt bag and who is squared away ,so you can ask him what the problem is directly after you dismissed your formation, he does not need an audience. That will take you down to option call the chaplain or chapter 13 .
I using chapter 13 because if theirs nothing Emotionally wrong with him ( wife had an affair) or something he just an a#$ hole and doesn't deserve to be their and nothing you do will change that.

Sadly it all depends on the race and/or sex of the service member .......... It also depends on branch of service too ....... My career is in jeopardy if I make a mistake here ........ .a lot of these situation are long in the making with a lot of advice from sea/barracks lawyers .....

I have to disagree in one aspect CPO Malay. None of that scenario depends on race/sex/education/background. The individual is a soldier, and as such, should certainly face punishment. Thanks for your service Joseph

First off. Stop what I am doing and all my focus is on this individual. Order him to do this task and assign another task as well. Document the issue and look for trends. Back in my day he would be assigned some extra curricular activities they call hazing today.

1st I would call everyone to attention & advise PFC Name & team leader to stand fast and everyone else continue on with there assigned work details. Then I would march them both to the 1SG's office & have PFC Name wait outside while T/leader & I have a discussion with the 1st shirt (I would 1st find out if I can rep;ace him( I would explain why). He then would to go back to his work detail. Now I would bring in PFC Name (dress him down good) & then see if I can get him a Company article 15.
