CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

In any case, the best advice when dealing with police is to follow their instructions completely. Disobeying the instructions of a police officer is a dangerous game, right, wrong or indifferent. One can always exercise one's right to sue at a later date. It is the responsibility of the police officer to later justify their actions. Excessive use of force in this instance may be proven, along with false arrest, but disobeying the instructions of an officer puts one in a compromising position. Remember, if a police officer feels threatened they are authorized to ACT. Whether or not that action is justified will come out later. I agree that the mere act of lawfully open carrying a weapon is NOT justification for action by law enforcement.

It is very clear that the Police committed a crime in this case. Olmos Park Police Chief Rene Valeniano and his crooked officers should be brought up on charges of assault with intent to do bodily harm, denial of rights, false arrest and any other criminal charges as they are clearly the criminals here. This is behaviour one would expect from police in the Fascist state of Kalifornication not Texas. Under no circumstances should police be allowed to act in this manner and against the law. These crooked police officers need to be made an example of so that police are forced to act within the law at all times.

The Mexican Military had to go in to a town and arrest the ENTIRE police station because of corruption. We need to do the same thing here.

Those police are in trouble. All aspects of their actions were excessive force. Glad I do not work there.

Well my friend, after the Chief is subpoenaed into court he will change his tune. He is ultimately responsible for the actions of his men. He is the one responsible for the officers training and he has deeper pockets than his men, and the city has even deeper pockets. I do believe that in Texas it is fine to open carry, they also have concealed carry . I really think that city is in for a very big lawsuit, and rightfully so. The police Chief, the stupid officer (that acted irresponsible), and the city will feel the heat. If there is anything involving race, they will have to put a going out of business sign.

Police Chief should be prosecuted and so should the cops who followed these ridiculous orders. TO ALL POLICE OFFICERS, IF YOU DON'T UNDERSTAND OR KNOW WHY YOUR ARRESTING SOMEONE, STOP, THINK AND PULL BACK.

This is a large part of the problem with open carry laws. The police should have requested them to tell them why they were in the park. CJ Grisham, President of Open Carry Texas apparently went to the park to trigger a confrontation because he knew how the police chief felt. As far as the police chief, he was also in the wrong. Chief Valenciano went to the park to intentionally confront CJ Grisham. There was no real reason to tase Grisham as he was only refusing, and not showing any real intent at hostility. They should both be taken to court and allow the court to decide on a punishement for them both.

Power corrupts if not controlled. Sounds as though he has the "I am the chief and my word rules" syndrome. Hopefully this situation get cleaned up before it gets out of hand

It is sad that the Police Chief and to those involved gives all LEO's a bad name. I truly hope they lose their jobs and their license to be LEO's anywhere in the USA.

It looks like there was an ordinance in place but it also appears said ordinance was very likely contrary to state law. The police chose to enforce the ordinance. It seems the debate here is if the police should have correctly realized the ordinance was contrary to state law and refused to enforce it. (Reading more responses in the thread it is clear that the chief knew the ordinance was contrary to state law).

As an aside the ordinance is now gone as a result.

Id also like to know if any senior leaders here petitioned to allow soldiers to store their personal weapons in their barracks rooms. To me that's just as equal a violation of their 2A rights.
