I have conflicting feelings over this. I know that open carry is a thing in Texas, but who crossed the line, if anyone?

CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.
Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).
Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).
Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.
Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

Wonder why the media never carried this story? This officer should be indicted for violating his oath, Texas Law, and their civil rights!

This could have ended badly. There comes a point where you submit to the unlawfully-applied legal authority and then proceed to argue the matter further in court. You don't make it an ego contest with a law enforcement officer, even if that police officer is entirely in the wrong. If you're not on post, then yes, you are required to submit to local law enforcement authorities.

I believe the SCOTUS has held that LEO's are not required to be 100% legally correct in upholding the law. If it takes an attorney many years of study, and passing a grueling BAR exam to practice law, is it reasonable to expect an LEO with 6 months of training, that by necessity must also include various other sundry aspects of law enforcement, to be fully knowledgeable of the law as well? So the arrest is probably defensible. How the DA proceeds with the case from that point forward is another matter entirely.

I just checked online and, at the time of the incident above, Olmos Park had an ordinance banning the carry of loaded weapons on city streets. The ordinance was later rescinded but at the time of this incident, it was in full effect and the "victims" were in violation of that law. Peacefully protest but don't carry loaded weapons and expect law enforcement officers to not respond.

First of all, this was one year ago but I am not going to respond to the above situation since there are no supporting facts. I have no reason to suspect that SSgt Leake (former, I assume, after seeing his profile photo) is not telling the truth but there is no attempt to present the other side. I am a police officer and know there is almost always "another side". If someone wants to accurately post that, then I would consider offering an opinion as to whether the officers screwed up -- and, like everyone else, we sometimes do make mistakes.

Well, CWO4 Miles Weaver, assumption is the mother of all fuck ups. Assuming that I wrote the article is your first mistake. You're not a very good police officer if that's the extension of your investigative skills. Secondly, assuming that I'm trying to portray law enforcement in a bad light, is your next downfall. Perhaps you should do some "investigating" on your own and watch the 23 minute video and listen to the recorded phone call between the Chief and the 1stSgt the day prior to said incident. Thirdly, line up your facts and notes before you attempt to look down on somebody. You've made yourself look rather pitiful.

First off... I wasn't there. Quarterbacking isn't a conservative value tool in the tool chest after the cards were played. Whatever the events were leading up to "tazing" need to be scrutinized very...very heavily. There damn better be a video and audio recording of the entire event....As a "FORMER" Chief of Police(New Mexico...not Texas) first off (IN MY HUMBLE OPINION!) I have other lower ranking officers who have been trained in use of force and the deployment of less than lethal force on cooperative and non cooperative subjects...Failure to use them is a failure of leadership. If there was no crime and advance notice was given of a lawful action by lawful citizens...why in the &^%* am I standing there with a tazer using it on my citizens I swore to protect? Peacekeeping and crowd control mean just that... was there violence before the tazing? if yes what level of violence? I only see an uncooperative person, refusing to cede to an unlawful order or an improper direction given by a person who can give orders but the order giver should have recognized the order given was not in fact legitimate... IN MY HUMBLE OPINION...again... I say... gather the Chief in the courtroom, impanel a jury of peers, Git a rope...and upon conviction... then... use the rope.

As patriots and law abiding citizens, we need to plan a National day of carry. Legal and peaceful, but in EVERY state. At every capitol. The powers that be need to see that we will NOT be cowed, we will not be silenced and we will never give up our second amendment rights!

Well it sounds to me that Grisham and "Crew" called on "Worse" by knowingly doing something that had already been recognized by them as something wrong and needing to be righted, however, they did not need to get themselves personally involved with the Police Chief or any of his Officers. In today's climate it should be common sense not to open carry while at a protest, let's look at the "Spirit of the Law" and not the "Letter of the Law"!!!!!!!!!
