CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

Growing up in San Antonio Texas during the 60s and 70s I learned that best way to deal with police is follow their directions and fight them in court. I live that way to this day. The street is not a court room where debate and legal arguments are held. Police are not lawyers and should not be expected to hold court in the street. I remember this incident and for me the SGM was just as wrong as the police.

I do say that the officers crossed the line absolutely, but even with that, a person cannot decide they are not under arrest, even if it is an improper arrest.

It is obvious the Police in that town are crooked along with the Police Chief. However, here’s my take on carrying open. Just say no to open carry. Carry concealed. No one needs any advanced warning you’re carrying. Never give an adversary an upper hand by knowing how much fire power you have. A 1SG should know that. Need a concealed permit? Get one - simple as that.

Need to contact the sheriff of the county as a police chief is under city authority, but the sheriff is the state constitutionally authorized authority. He serves the people, not a city clique.

This should now be a matter for the Courts. Our Justice System provides that, after Law Enforcement has acted, the actions of all involved may be put before the scrutiny of the Court; at this point, a judge will need to decide, unless there is also a jury involved at which point it becomes a team effort.

The accused need to be careful and meticulous in their defense. They are innocent until proven guilty. With that said, the State Prosecutor will do what has to be done to make that happen. That's the job. Now, the Defense Attorney needs to figure out a strategy to bring the truth of the matter into the courtroom.

The phone conversation might be a good place to start. Also, LEO body-camera records would be helpful. Normally, I support Law Enforcement; we all should. In this case, the Court needs to sort this out and render a judgement.

1. when given a directive by law enforcement follow it. you may not like it , you may believe it is illegal, on the scene in the possession of weapons in not the time nor place to question or challenge legal authority.
2. get a lawyer and file a suit against the city/county/police and the chief as an individual. lawyers will probably take a case like this on a percentage basis or at not cost to gain publicity.

I agree these cops were out of line people are confused about the Bill that was passed! As of yet that Bill has not been approved by the Governor, I believe it has one more hurdle to go before Abbott can approve it officially so anyone walking around with a handgun openly is in violation of the ordinance in place right now! At the end of the day as a citizen you are playing with your life if a cop reacts in "fear"! Qualified Immunity will almost guarantee an acquittal if the cop uses the magic phrase "I feared for my life"! Short of video being shot of these guys actually committing crimes it will be your word against theirs! If you want to express your 2nd Amendment then get organized and imo should have your cameras set on live FB or whatever social platform that can go live so if they confiscate your phones there will be a record saved of the incident online which they cannot destroy!
