No. I think Prefnat w/o permission should be brought back. If the father is military he should be subject to the same charge.

Many years ago, the military banned marriages to foreign nationals without the CO's permission. That was ruled unconstitutional. In response, the military mandated counseling prior to such a marriage. One of the concerns related to immigration issues with the prospective spouse. Any outright ban on marriage would be unconstitutional. However, a regulation requiring marriage counseling before marriage should be OK.
