The Army kicked me out, what do I do?

The army kicked me out. I'm made as hell. What do I do?
I went to the promotion board to move up from O-1 to O-2. Yes, my OER's all said needs improvement but they weren't below satisfactory (My last really good OER was BOLC).
Army does a deep dive into my past and pulls up and arrest from 10 years ago. Its one of those I cant get exspunged because of federal law. There is a DOD policy, paragraph 6.5.2 reads "may not use this as sole cause to take negetive administrative action against the person who is subject to this statute."
The Army decided that they weren't going to promote me. Fast Forward 3 years and I manage to get onto active duty orders. They give me my notice and boot me out in 40 days. I left with 22 days active duty, 10 years 6 months in service. Honorable Discharge.
Does anyone have any thoughts or ideas about what I should do or could do? I tried getting back in but the higher-ups said no.

Yeeeaaaaaa.......You're not coming back in as an Officer. Let's look at the list:
OER: All of the OERs you've received all stated "Need Improvement." That, in layman terms, is below satisfactory.
Record: You have a Federal Arrest on your record. I'm rather surprised that you were granted a Moral Waiver.
Your record PLUS the not good OERs are the reason why you got passed over and booted. In the realm of the Army when RIF happens, those that are not meeting/exceeding standards are usually the first to be shown the door.
You can try coming back in the Army as Enlisted, but you'll never see Officer rank again. You could try for Commission in any of the Sister branches....but, chances are that won't happen because of your OERs and record. You can certainly try, but don't count those chickens.

You don't get an OER for BOLC, you get an AER (1059). You can't get an OER until you have BOLC complete.
So, the blocks on the OERs may have been "Proficient" or "Capable", but when the rater actually uses words like "needs improvement" on an eval, a board reads that as "probably even worse than the rater is letting on". Because evals usually only highlight the positive, unless there is just too much negative to completely ignore.
You can only be a 2LT for 42 months, you have to be selected for 1LT by then or you can't stay in, at least commissioned.
You ask what a moral waiver is, that tells me part of the problem with the board was the initial failure to disclose that arrest.
But it was probably mostly the OERs.
Or we're not getting the whole story here.

You might be able to get back in the Guard as enlisted, as an E5 with credit for BLC equivalency (BOLC), or a higher grade if you previously held one and had the requisite PME complete for it.
You'll need to talk to a recruiter about that.

These senior NCOs here have given you the BLUF assessment. When I was the 1st lieutenant, I was fired as the S1 during annual training because we were so short staffed and the executive officer said it was OK for me to stay at the combat train's command post. I had good or OK evaluation reports in the military police corps before I switched over to armor. I myself had a need improvement officer evaluation report back then it was considered a refer report. Then I was given a relief for cause because I couldn't make the battalion staff meetings while we were out in the field and I couldn't get a ride or I didn't reach out by radio ( Cell phone signal bad in Yakima )to get a ride to the staff meeting. My S1 N COI C went but I didn't go. I was relieved for cause. I then had a negative Is officer evaluation report but I gave a good rebuttal describing how screwed up things were. Because I fought my negative OER And because I had 2 years of decent OERs As a lieutenant in the MP corps and because I did well on maxing the PT ( Getting Consistent 300 On my APFT as a 35 year old lieutenant surprised many and possibly helped When the board convened to decide to allow me to become a captain )
I remember when I was going through my California Military Academy CMA which was a state franchise officer candidate school. It was an 18 month long program Instead of those condensed 90 day Wonder like the Courses offered at Fort Benning or Fort mcclellan. Over the course of time one of the instructors started off as a captain and ended up being an instructor as a sergeant. Maybe he didn't complete his bachelor's degree back in the late nineties and he reverted to E5.
Maybe there is a glimmer of hope since the army has lowered the standards because retention is in the toilet and active and reserve components are hurting especially when 20K reserve and 40K guard don't want to take the mandatory covid 19 vaccine. I am sure many of them are going to get chaptered out and this may be a good opportunity for you. You already know what you need to do based on your negative officer evaluation reports.
I am sure if you Do a deep dive and figure out exactly what you did wrong or what personality traits were the defaults of character and you fix them, maybe you have a chance later.
So if you get back in and you make it to E7 or even E8, you can still retire as a second lieutenant Since that was your highest rank attained.
You do have the hurdle for not being forthcoming with your criminal offense past.
I'm not sure if the reason you were probably also kicked out is because you couldn't even get a secret clearance.
I am not sure what MOS you can have and not have a secret clearance as an E5 or above? That may be a hurdle that you're gonna have to ask about because because most senior ncos end up getting a clearance.

SGM, I will put money down for the most expensive beer that we're not getting the full story.
There is a lot missing from here and I suspect that is purposeful. AD promotion from 2LT to 1LT is automatic at 18months, so were you reserves? Who kicked you out RA, NG, or USAR? No real need to reply, simple reality your days commissioned outside of WWIII are done. Time to move on and find something else to be of service to your country (if so desired).
