The army kicked me out. I'm made as hell. What do I do?

I went to the promotion board to move up from O-1 to O-2. Yes, my OER's all said needs improvement but they weren't below satisfactory (My last really good OER was BOLC).

Army does a deep dive into my past and pulls up and arrest from 10 years ago. Its one of those I cant get exspunged because of federal law. There is a DOD policy, paragraph 6.5.2 reads "may not use this as sole cause to take negetive administrative action against the person who is subject to this statute."

The Army decided that they weren't going to promote me. Fast Forward 3 years and I manage to get onto active duty orders. They give me my notice and boot me out in 40 days. I left with 22 days active duty, 10 years 6 months in service. Honorable Discharge.

Does anyone have any thoughts or ideas about what I should do or could do? I tried getting back in but the higher-ups said no.

Yeeeaaaaaa.......You're not coming back in as an Officer. Let's look at the list:

OER: All of the OERs you've received all stated "Need Improvement." That, in layman terms, is below satisfactory.

Record: You have a Federal Arrest on your record. I'm rather surprised that you were granted a Moral Waiver.

Your record PLUS the not good OERs are the reason why you got passed over and booted. In the realm of the Army when RIF happens, those that are not meeting/exceeding standards are usually the first to be shown the door.

You can try coming back in the Army as Enlisted, but you'll never see Officer rank again. You could try for Commission in any of the Sister branches....but, chances are that won't happen because of your OERs and record. You can certainly try, but don't count those chickens.

2LT Ben B - Conduct (Moral) Waiver - A conduct or moral waiver is required when the final finding of a court or of another adjudicating authority is a conviction or other adverse adjudication such as, but not limited to, fines, imprisonment, placed on probation, paroled or pardoned, or have ever been ordered to deposit bail or collateral for a violation of any law, police regulation or ordinance, including traffic violations involving a fine or forfeiture of $100 or more. This includes juvenile offenses, expunged dispositions, non-judicial punishments, and courts-martial proceedings. Serious misconduct and major misconduct offenses require General Officer endorsement, Moral Waiver Case Summary, and submission no less than eight weeks prior to the desired board's deadline.

Again, as for coming back in as Enlisted, you will have to speak with a Recruiter.

Question is, why should the Army take you? Looks like all you offer is drama. It cheaper to get a O1 with zero service and move on.

You kicked yourself out.

Poor performance and undisclosed trouble with the law - as an Officer and (supposed) gentleman.

Be as mad as you want. Just make sure you are looking in the mirror.
