I was notified May 3rd that I have till 1 November to leave the service and never be able to serve again due to overweight 3 years ago. With 60 days saved leave that puts me at 4 months to find a new career after serving 11 years.

This junk is the reason that I embraced my ETS with open arms. My last unit had a perpetual E-1 who could never make the standard to get his rank and didn't care. Stuck around for years at the same rank while others were being chaptered for silly reasons in comparison. Meanwhile the Soldiers that worked hard and made the occasional honest mistakes because they put themselves out there more often were slapped with article 15's at the first opportunity.

SSG Santana's question is still unanswered. Why do we have less than seven months to complete outprocessing and get out. Our due date is November 1.

I just answered it. "First day of the 7th month" not "7 Months" and you can always sell your leave.

I have the same situation. I was notified May 16 and have the bloody same date (November 1) to leave. I don't understand it, either.

I am sure they are looking at a much bigger picture, ratings over the last three years, pt scores, current height and weight and body fat. Plus the 11 year Staff Sergeant bit, and your promotability potential. If any of those don't look good they are cleaning up the ranks and making room for personnel who should be promoted and have future promotability potential.

As long all your statements are valid and in no way altered from the information given to you already, also having you exhausted all attempts to solve your case through your current command, you may look into this option:
Note – Be advice I am no legal representative nor hold any administrative billet to advice you or recommend anything. As I mentioned above there is nothing worst than falsifying information or federal documentation and am pretty sure that many top officials will agree with me that this is not how the Army functions. Nevertheless, taking in consideration of all your statements you should talk to your chain of command from/to but not limited: SQUAD – PLATOON – COMMAND – BATTALION – BRIGADE – DIVISION – CORPS – FIELD ARMY, in that order. If your statements are correct and possible falsification of documentation took place then this case could be subject to be considered for as:
Grievances: Article 138 Complaint
Under Article 138 of the Uniform Code of Military Justice, any member of the armed forces who believes himself or herself wronged by his or her commanding officer may request redress. By requesting redress the wronged member of the military is asking that the “problem” be addressed and fixed. Army Regulations [1] define a “wrong” as:
A discretionary act or omission by a commanding officer, under color of Federal military authority, that adversely affects the complainant personally and that is-
(1) In violation of law or regulation;
(2) Beyond the legitimate authority of that commanding officer;
(3) Arbitrary, capricious, or an abuse of discretion; or
(4) Materially unfair.

Be advise if your statements are wrong they can be held in contempt of court per UCMJ. Now if you simply want to just promote more supervision among service members in regards with meeting standards and well documented records, awesome. Lesson learned. I think you have been given a lot of resources to make a positive outcome of this and their is nothing wrong in serving under the reserve component. I am actually serving in the reserve component and I have time to handle other priorities in life like getting my BA in Engineering.

SSG The Army is ran by Humans, we by nature are susceptible to mistakes, negligence and many miscalculations. Unless you are carrying in your records a heavy burden in other words a negative evaluation, for many reasons other than AR-600-9... then it will explain why this is happening to you. I think someone in this forum did hit the target when they simply asked about your SPN or separation code. That defines the reason pretty much. Regardless, every one without any particular rank has a different mindset.

SFC Phillips, I have a question the 11 year SSG thing? I am not sure what MOS you are, but right now that is fast tracking in a lot of MOS s. I also noticed that SSG Santana said he has had zero issues since and he is serving in a SFC slot appointed by a Colonel. I am not sure what else he can do, yes he screwed up once, but to QMP him for that when we are letting DUI s off the hook come on.

Sounds to me that you were notified three years ago to get within army standards or risk separation from the service. If you are still not in compliance, you choose the latter. The SFL-TAL will be a great asset during you transition. You should enroll quickly and they will walk you through all you options and benefits. Separating honorable after 11 years is still a remarkable achievement. You might find yourself better suited for civilian positions that allow you to continue towards a retirement.

Don't forget to file for unemployment when your leave runs out. Most states you can draw for six months. It's money you have earned, don't be afraid to take advantage of it. I know plenty of joes that didn't know they could do that when terminal leave ran out. They ended up spending their savings trying to stay on top of things before they settled back into civilian life.

Sorry to see how you are being treated. But at least you got 11 years. I tried to enlist but due to no fault of my own (congenital cataracts) was denied even though I scored top 2% on ASVAB and vision was correctable to 20/20 and I had some college. Military life was all I knew. I was an Air Force brat, then a Marine brat and finally a Navy brat. Anyway I wish I could have gotten any time as active duty so I am jealous. Keep your head up, the civilian world isn't that bad. Thanks for the 11 years that you safeguarded my freedom.

Rgr, that's why I post it here so people can see it's real and happens even for somethingike your waist size, I understand the regulation, but I became compliant within the allotted time, just not before my ncoer was due
