You do realize that the bathroom was at the victim's home, and that the defendant was a family friend, don't you? Exactly how would a law dealing with public restrooms have affected a bathroom in a residence?

The headline, while technically accurate, is misleading and plays into to the myth that allowing transgenders to use the bathroom that they identify with in a public setting puts people at risk. So instead of publishing the truth, that this was a sexual assault of the vilest nature, but of the same pattern as most sexual assaults of children, why not sensationalize it to use it in a manner completely at odds with the facts.

Jeez, is there anything y'all won't do or say to make your political point?

SMSgt Diana Pasterchick - what the hell are you talking about? I'm not defending the pedophile, I've stated that if guilty he should be convicted and punished to the full extent of the law, I stated that this was a sexual assault of the vilest nature, and so on.

That, however, has nothing to do with pointing out that the media reports are misleading, designed to whip up emotions against transgender use of public restrooms by leaving the false impression that this incident happened in a public restroom. I'm not generally in favor of lies by the media, are you?

Finally, everyone is entitled to defense counsel, and that's what I do. I would have absolutely no problem with protecting the rights of Martinez. What's more, you swore to defend the Constitution, which includes the Fifth, Sixth, Eighth, and Fourteenth Amendments--that protects his right to counsel. The Founding Fathers understood this clearly, John Adams was the defense attorney for the British soldiers accused of murder in the Boston Massacre, and obtained the acquittal of all but two, and those two did not receive prison time, instead they were branded on the thumb. This trial is also where the term "reasonable doubt" first appeared in the practice of law.

The more important question is why don't you support the right of Martinez to competent legal representation? Do you not believe in the American justice system? Do you not believe that people accused of a crime are presumed innocent until proven guilty beyond a reasonable doubt? Don't you believe that everyone is entitled to a fair trial? What kind of person are you?

BTW, Martinez was convicted. He faces up to 70 years in prison. I'm fine with that type of sentence, and always have been.

Thanks for your very detailed response. The fact that you got ALL THAT from TWO sentences in which I never mentioned defense entitlements, legal representation and how I feel about our country's history is quite amazing... Fight the good fight Capt. This conversation is over.

SMSgt Diana Pasterchick - I noticed that you didn't answer the question on lies by the media, or on whether or not you believe in the protections that the accused get in the court system in this great nation. Why is that? No matter, the real point is that you get bent out of shape and make an unwarranted conclusion on my position, address it by language resembling an attack, yet I'm not supposed to respond? LOL, yeah, right.

Next time you think you know what someone's position is, you may want to take a second to see if that's actually what they think, or <gasp> you could even ask them instead of jumping to conclusions.

You could pose your point or position in a reasoned, rational manner, rather than using one of the two sentences of your response to make a distasteful play on the Capt.'s name. Raising the level of your conversation above that of the fourth grade playground bully WILL gain quite a bit of respect for you and your position when speaking with other adults.

Miguel Martinez, who goes by the name Michelle, isn't IMV, a transgender. He is a dyed-in-the-wool pervert. If found guilty, he'll hopefully have a long time to play the woman in the general population of a men's prison.

SSG(P) (Join to see) - I very highly doubt that. You legally are not guilty in court unless you are found guilty by a jury or a judge or you plead guilty. So legally you were innocent unless you were proven guilty.

So you took a plea deal...that's on you. I honestly would have gotten a new lawyer if I was ever charged with a crime I didn't commit. I would not take a plea deal if I did nothing wrong.

You did not get fucked by the system. At all.

Legally you were innocent the entire time until you took that plea deal.
