What a great and enlightening Post SGT (Join to see)! As I read this article, I was amazed at the many convoluted loopholes involved in purchasing a gun! Many "Rules" are right on target and reasonable, but others are a sham... No matter how one slices it, the "Criminals", regardless of who or when, will always have access to guns of all types... Those folks who obey the laws should always be allowed to own a gun for their own protection and that of their families...
It sure is a confusing scenario, though! Thanks again, Rick!

The biggest pitfall for NICS is the HIPAA privacy rule. The ATF Form 4473 and HIPAA conflict when it comes to medical records. Paraphrasing but the 4473 asks if one has ever been involuntarily committed to a mental health facility. Because of state by state interpretations of federal HIPAA law, the admission to a mental health facility may or may not be reported to the FBI and thus NICS.
