The fact that the Supreme Court has ever ruled that schools can infringe on free speech is ridiculous. Tinker was a terribly decided case, and it is on the back of Tinker that there is even a rationale for this case. If the court was honest it would recognize the inarguable fact that public schools are government entities, thus they must, without exception, remain within the restrictions set forth on the government in the constitution, thereby precluding the ability of the schools to do anything to infringe on free speech. And to act as if the schools even apply the Tinker ruling equally across the board is to admit to one's own ignorance of the situation occurring across the country in our schools.
