"As a general matter, an initial aggressor loses the right to act in self-defense unless he first withdraws from the conflict or retreats and communicates his withdrawal to the other party."
The above quote is directly from the WI law concerning "Initial Aggressor".
My understanding of the chain of events prior to Kyle shooting his 1st assailant, as shown in the video, is that Kyle did retreat. He ran in between the cars on the side of the building. According to news coverage of the deliberations, this time period seems to be the sticking point on getting united verdict. The prosecution says that Kyle instigated(became the aggressor) the incident by pointing his rifle while standing in front of the building. I say incidental movement after setting down the fire extinguisher, prior to retreating to the cover of the vehicles.
But, I'm just an average guy living in the boonies.
