To be clear, the investigator said Biden would likely use age as a defense:

"Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,”"

This does not mean he is saying Biden suffered from mental decline. However, he did say that Biden was unable to accurately account for how the docs got there, the things he said and did with those files, and confirmed Biden at certain points back in 2017 knew he had them. So, unlike what Trump did. Biden had to have willingly taken them without authorization and knowingly retained them until... They discovered Trump had a whole bunch too. The difference is, Trump had authorization to take them AT THE TIME. While the government is well within their rights to demand them back, 1. Didn't need to be public and 2. They could have allowed the challenge by Trump to conclude without sending in a team of FBI agents to raid his home. This really was unecessary and it demonstrates an appearance of bias in the application of law enforcement.

While some might dismiss this and say tons of people do it and no one takes classified information seriously, I have to say that is BS. Almost all of my 28 years in the Air Force were spent in classified facilities of various types, and a majority of those were in SCIFS. We took it very seriously. Mistakes were made of course, and they were dealt with appropriately. What some do not understand, is that when you get to the Senior leader level, such as Flag Officers, SES, and specific elected officials (like the President and Vise President) certain accommodations are made for these people. I know because I've been a part of facilitating it. Their homes become authorized for the storage of TS/SCI and some even get connectivity to secure networks. This is why I think we should not be reporting any of this, to include Trump's and Biden's transgressions. This is not like me taking classified files home (by accident or not), retiring from the Air Force, and one day having someone discover unsecured classified files. Also, when there is a Classified Message Incident (CMI), does the whole world get to know, the whole organization? No, not unless it turns out that the individual was a spy or acted highly illegally to the point where the government releases a statement in the media. These officials / elected leaders are on a whole different level. This isn't to say we shouldn't pursue these files and remove them once they are no longer in office. But that does not need to become something the American people (or the world for that matter) need to know. Honestly, this whole thing is stupid.
