you are mistaken about the date that photo was taken. I'm not sure where you got that date attached to that photo from but whomever they were misleading you conflating the date of the ad with the date and reason it was taken. That was taken in 2010 during Biden's time as VP as part of an official duty as VP, that's why the photo was allowed. If Trump had bothered to go to Arlington as POTUS he too could have had official shots taken of him there and they later could have been legally used for other purposes. But as far as I know he didn't, and that t also tells us a little about why he now went there.

Maj William W. 'Bill' Price I looked and Trump did go to Arlington for Memorial Day for several years as POTUS at there are lots of photos of him there. Those were all legally taken for a legal purpose and he could have used them for his campaign without legal issue (some may be copyrighted but I'm sure most are in the public domain), but he chose not to.

My assumption that there were no photos taken and thus no visits to Arlington as POTUS was because it is a complete mystery to me why he wouldn't have just used one of those. But of course, I'm a person who normally follows and respects the law and my thought process goes along those lanes.
