My surprise comes that this was said in public on more than one occasion. The First Amendment protects advocacy for armed protest participation, legal risks arise if the rhetoric crosses into incitement, facilitates intimidation, or directly enables violations of firearm laws. Courts would scrutinize whether the speech was directed toward unlawful action and whether it posed an imminent threat. The courts would have to decide.

SPC Daley, I Totally agree with the first amendment. I believe in free speech but I also believe that you should be held accountable for the contents. If you call your neighbor an SOB that’s your right to do so but I think that you should be able to prove it if called to.
