As we saw with the Southerland Springs Baptist Church killer, while he did have a criminal record in the Air Force, that information wasn't forwarded to the NICS system, so he was able to buy that gun legally. All background checks are only as effective as the information behind them.

I am sure they don't catch everyone. If you don't yet have a record, then there is nothing to "catch"
