Menacing is a class B misdemeanor in NY state. If you are convicted you could be sent to jail for up to 3 months, and you may be ordered to pay a fine of up to $500. Vigorous prosecution and hard-line judges are the solution. I don't know the stats, but I bet when caught and convicted in NY for menacing, judges pat the offenders on the fanny, tell them "that's no way to behave," give them a lollipop and send them on their way.
