Confederate solders are recognized as U.S veterans. They fought under this flag and I am sure many were buried under it.

Capt Michael Greene - And if it is at a Confederate Cemetery, It would be an honor for the persons that are interned there. That is the flag they fought for! Would be like taking the American flag form the cemeteries in Normandy! It is just like PO1 William "Chip" Nagel said "Freedom of Speech". So if I use my freedom of speech, to fly the Confederate flag, that is my 1st AMENDMENT RIGHT or is that against the law. Just the opposing persons freedoms not ours!

While I'm not real fond of this symbol. I believe in the 1st Amendment and in this case, If they served under the Confederate Flag and someone thinks their flag should be on their grave, So Be It.
