One variant is Weeping Angel. Nothing new with that. They also have long been able to use a smartphone as a hot mike in owner's location. It entails installing an app in phone without user being aware. There aren't very many symptoms to tip owner off other than lagging performance etc. Since "tower issues" and "bandwidth issues" are common, most would never know they are transmitting. Once installed the only way to disable is to remove battery. Simply turning phone off doesn't defeat it. Folks in the business use encrypted/secure phones because they understand the threat(s). If Big Brother wants to listen, they will - legally or otherwise. Only requirement for warrant is if they want to use info in court. All else is illegal but can still be used internally to ferret out bad actors. Just don't try to go to court with it.
