Allegedly the Sheriffs Office only had given ICE 16 minutes warning. In the jurisdiction that I worked in if you put a hold on a prisoner you would have to back it up with paperwork (arrest warrant or teletype message from another agency stating that they would be on the way to get the prisoner) . If you requested that you be notified before the prisoner was released the detention center would call you as soon as they had word that the prisoner would be released. It sounds like a SNAFU between the Sheriffs office and ICE. Someone is going to catch holy hell for this.

Yeah, except this isn't a sanctuary city issue.

ICE had a hold on him and the jail complied. The jail notified ICE that the individual was going to be released. ICE said that they didn't have time to pick him up, so the jail released him, as the law requires. If ICE can't pick the suspect up and doesn't bother to get a judge to issue a warrant to hold the person, the jail doesn't have a choice. ICE had plenty of time to procure a warrant while the guy was setting in jail but didn't do so.

This is on ICE, not the county.

So you think 16 minutes is adequate advance notice for ICE to pick someone up, Capt Gregory Prickett? Perhaps if ICE was located in the same building as the courthouse, but I'm guessing they're not co-located.

SSgt Christopher Brose - no, but I think that ICE had plenty of time to get a warrant. They flagged him two weeks ago, but were too lazy to do what was necessary to legally hold him. If you only want a phone call, then that's what you get, and it is typically at the time of release. If you want the subject held, you get a warrant.

SFC William Farrell - the article said when ICE flagged him. I was a cop for over 20 years, so I know what it takes to get a warrant (it's really easy). I've seen holds on people for all sorts of things, and people don't get held without a warrant. Next, I'm now a lawyer, and I understand the law involved. The jail cannot hold someone just because someone calls them and asks them to--they have to provide a warrant or court order of some type. Next, case law is clear that if the county holds the person past his release, the county has violated his constitutional rights and the subject is entitled to damages. ICE won't pay for those damages, even though they are demanding that the person be held. So why should the county risk a 6-figure judgment because ICE is too lazy to get a warrant?
