If you only want a phone call, then that's what you get, and it is typically at the time of release. If you want the subject held, you get a warrant.

I've seen holds on people for all sorts of things, and people don't get held without a warrant. Next, I'm now a lawyer, and I understand the law involved. The jail cannot hold someone just because someone calls them and asks them to--they have to provide a warrant or court order of some type. Next, case law is clear that if the county holds the person past his release, the county has violated his constitutional rights and the subject is entitled to damages. ICE won't pay for those damages, even though they are demanding that the person be held. So why should the county risk a 6-figure judgment because ICE is too lazy to get a warrant?
