I have a pretty 'complicated' medical case but the VA continues to refuse at times to even consult with me despite internal VA referrals for the consults. They also refuse to refer me to anyone who possibly CAN help-- or the Mission Act options don't have any providers for the care needed within hours of me. Then they refuse to cover many of the meds that outside specialists suggest, costing me >$3,000 per year out-of-pocket. Is this OK at any level and would anyone have any suggestions for how to get the needed care? This way preceeded COVID-19 issues but continues despite it. I've been told the doctors won't even agree to a telehealth or video health consult at the VA across a few departments and programs. I'd already involved a senator's office a few years back and have made almost no progress. Help, please?

I am normally a very optimistic person, however when it comes to dealing with the VA!!! To answer your question in short form. YES, they can. WHY? Because the VA can do whatever they damn well want to do and no one is around to stop them. Sure get a lawyer, will you live long enough to get your answer? The VA will bet that you don't. Ever hear of the saying "DENY UNTIL THEY DIE"? That has not changed and it applies to any decision the VA has to make when it comes to the treatment of Veterans.

If you have a ligament case then I would write your congress person and even the Secretary of the VA https://www.va.gov/opa/bios/secva.asp#:~:text=The%20Honorable%20Denis%20Richard%20McDonough,11th%20Secretary%20of%20Veterans%20Affairs. I don't know your whole case but I know some has been rejected because they have became Hypochondriacs. I hope this is not you situation.

I'd reach out to a vet that is also an attorney. His name is Brain Lewis, [login to see] . I have never used him and he is out of MN BUT he maybe able to direct you to someone or suggest something that may help you.

I sent a letter to President Trump addressed to the White House.
I was very impressed with the quick response I received back from the White House and within weeks held a letter in my hand from Naval-Base Kitsap-Bangor who investigated my request.
I hope this will encourage you.

I am also a 100% and the V.A. have addressed all my medical issues but the V.A. doe have many flaws but they will work with you and you will be sent to many wrong people with all wrong answers.

Exercise and a positive attitude have a drastic effect on pain issues. They removed shrapnel from me and never complained a second. In the process they placed titanium to help me stand up, it worked after much effort on my part.

The main issue with that even though it is a "Federal Program", it does not work the same in each state. The VA works independently in each state. One would think that it is the same but it is not. If you know anyone who has ever been part of the caregiver program, or who has ever moved from one state to another; they would have experienced this. I moved and I was dropped from care, and wa also dropped from the caregiver program. Had to reapply for both. Once I reapplied I was denied. I was medically retired on 100% disability. Once I reapplied and approved in the caregiver program I went from highest tier to the lowest. In order to just get that I had to appeal to the Director for Vison-1. So, the advice is great. But what works for one of us in one state doesn't always work for another Vet in another state. As each state VA system runs its own way, and follows its own set of rules. The only think they follow the same is the rating system. I would contact the Director for that region. And if you are more than 40 miles from the VA hospital they have no choice but to approve "outside network care". I have 4 back surgeries, I live 2 hours from the closest VA hospital. I get all outside network care, except once a year to see my PCP.
