CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

It is sad that the Police Chief and to those involved gives all LEO's a bad name. I truly hope they lose their jobs and their license to be LEO's anywhere in the USA.

I think it is a simple matter of common sense. Once your licensed, it can be a good feeling to know you can carry your pistol openly in public. However, it comes with great responsibility. There is a responsibility for carrying a deadly weapon in public that many are not fully aware of. Those who are or who were in law enforcement know this responsibility well. Carrying a gun in public doesn't make you tougher or shouldn't make you feel superior. It should be just to inform those around you that you are trained with it and of its presence.
If you want to carry a gun that bad anywhere without question then become a cop. Otherwise, be content with being able carry a weapon in certain parts of society and hope you never have to really use it to protect yourself or your family.

I don't think that this about being tougher or feeling superior. While not being my first option (first being conceal carry), I think open carry is a nice option to have in certain situations like doing outdoor activities. Also, when riding a motorcycle in a unfamiliar area. You can't exactly roll up your windows on a person when you are on your scoot. Open carry when you are hiking is also much more comfortable when you are moving actively moving around.

Setting aside the legal right to carry in that particular state. Perhaps the gentlemen in question should have gotten on the ground when the officer told him to do so.

Given the possibility of being shot, it makes sense to comply and utilize the courts if you feel slighted. I'd rather be judged by 12 than carried by six. If a LEO wants to live, he may face that choice. This was an intentional publicity stunt in furtherance of OCT. It would have been a non-event if Grisham had merely complied and settled in court.

It looks like there was an ordinance in place but it also appears said ordinance was very likely contrary to state law. The police chose to enforce the ordinance. It seems the debate here is if the police should have correctly realized the ordinance was contrary to state law and refused to enforce it. (Reading more responses in the thread it is clear that the chief knew the ordinance was contrary to state law).

As an aside the ordinance is now gone as a result.

This was gross misconduct. The Chief already had an exchange with Grisham and it would appear, made sure he was on-scene to administer his own dose of summary judgment. Illegal and at the very least, deprivation if civil rights under the color of authority. Chief Valenciano should be investigated and terminated and not allowed to be a police chief anywhere in America.

I don't understand -if open carry is the law, then why was there an arrest? Why was there a conflict? If the MSG was in compliance- then the local authorities went over the line. If the MSG was not in compliance, then he went over the line, simple.

Id also like to know if any senior leaders here petitioned to allow soldiers to store their personal weapons in their barracks rooms. To me that's just as equal a violation of their 2A rights.

The people were not breaking the law, unless there was signage indicating no guns allowed in that area. As stated by another just use a little common since and help the police out. Their job is hard enough without throwing a wrench in the batter. This day and age of video and cell phones etc as police officers be aware of your surroundings. Don't make stupid mistakes. It would had been so easy to approach the men in question, pull them aside and help them to see why you do need more guns. I would had bet those men would had back to their car and lock them up or left the AO. Another scenario what if they had a reason to be there. You already pissed the men off having them lay on the ground! The men are going to pee in your Wheaties, rather than cooperate.
