Insurrection

Henry "Enrique" Tarrio, former leader of the right-wing extremist group Proud Boys, was sentenced to 22 years in prison for his role in the Capitol insurrection — the longest sentence yet in the Jan. 6 cases.Sep 1, 2023.

Here's a look at the longest sentences individuals have received so far in relation to the insurrection:

1. Henry "Enrique" Tarrio, former leader of the right-wing extremist group Proud Boys, was sentenced to 22 years in prison for his role in the Capitol insurrection — the longest sentence yet in the Jan. 6 cases.
* Tarrio was found guilty in May of seditious conspiracy related to Jan. 6, alongside other Proud Boys members.
* He wasn't at the Capitol riot because he was arrested days earlier, but prosecutors argued that Tarrio maintained command over the Proud Boys and cheered on the group as its members stormed the Capitol.
* Prosecutors noted Tarrio took credit for the riot on behalf of the group.

2. Stewart Rhodes, the founder of the far-right militia group Oath Keepers, is serving one the longest sentences thus far with an 18-year prison term.
* A jury last November found Rhodes guilty of seditious conspiracy in one of the landmark cases the Department of Justice brought against participants in the Capitol riot.
* Federal prosecutors said Rhodes and a group of Oath Keepers led a plot to halt the certification of the 2020 election results in an effort to keep Trump in power.

3. Ethan Nordean, a U.S. military veteran who led the Seattle chapter of the Proud Boys, was also sentenced to 18 years in prison on Friday.
* Nordean, accused of helping plan the group's march, was part of the extremist group's "national rally planning" effort, per the DOJ.
* He was found guilty earlier this year of seditious conspiracy for his role in the attack. Prosecutors were seeking a 27-year prison sentence.

4. Joseph Biggs, a former leader of the Proud Boys, was sentenced to 17 years in prison this week after being found guilty of seditious conspiracy in May.
* The sentence is about half as long as what prosecutors requested as the DOJ asked that Biggs serve 33 years in prison.

5. Zachary Rehl, who was the president of the Proud Boys' Philadelphia chapter, was sentenced alongside Biggs this week to 15 years in prison.
* He was found guilty of multiple felonies, including seditious conspiracy and conspiracy to obstruct an official proceeding.

6. Peter Schwartz was sentenced in May to 14 years in prison after being found guilty on 10 charges, including four felony charges of assaulting, resisting or impeding officers while using a dangerous weapon.
* He was convicted by a jury for throwing a chair at officers and spraying them with pepper spray.

7. Kelly Meggs was sentenced to 12 years in prison after being found guilty of seditious conspiracy and other felonies in a November 2022 trial.
* Meggs, who was one of Rhodes' top deputies, was sentenced alongside him.

A Jan. 6 rioter was convicted and sentenced in secret. No one will say why

WASHINGTON (AP) — Hundreds of rioters have been charged, convicted and sentenced for joining the mob attack on the U.S. Capitol. Unlike their cases, Samuel Lazar’s appears to have been resolved in secret — kept under seal with no explanation, even after his release from prison.

Lazar, 37, of Ephrata, Pennsylvania, was arrested in July 2021 on charges that he came to the Capitol on Jan. 6, 2021, dressed in tactical gear and protective goggles, and used chemical spray on officers who were desperately trying to beat back the angry Donald Trump supporters.

There is no public record of a conviction or a sentence in Lazar’s court docket.

But the Bureau of Prisons told The Associated Press that the man was released from federal custody this week after completing a sentence for assaulting or resisting a federal officer. Lazar was sentenced in Washington’s federal court on March 17 to 30 months in prison, according to the Bureau of Prisons, but there’s no public record of such a hearing. He had been jailed since July 2021.

3a.) Ephrata Jan. 6 defendant Samuel Lazar out of federal prison; mystery surrounds case [update]

Nearly two years after his arrest for his actions on Jan. 6 outside the U.S. Capitol, Samuel Lazar has been released from federal prison to a halfway house in Philadelphia.

Lazar, 37, was arrested at his Ephrata apartment on July 26, 2021, and is charged with obstruction and assault-related charges. His release came to light via a post on his sister’s Facebook page.

Video footage from Jan. 6 shows Lazar spraying police with pepper spray, taunting them and urging others to “take their guns.” 

Lazar’s appearance that day — camouflage face-paint, goggles and tactical vest — earned him the hashtag #facepaintblowhard by online vigilantes who have been working to identify people sought by the FBI.

The circumstances leading to the resolution of Lazar’s prosecution remain a mystery. The federal court docket contains no information about a plea agreement or sentencing. A federal judge in May declined a request by media organizations to unseal any parts of the docket that may be sealed.

Patty Hartman, spokesperson for the District of Columbia U.S. Attorney’s Office, said she was unable to provide further information because Lazar's case is sealed. 

30-month sentence?
Lazar’s attorney Hope LeFeber said she was unaware her client had been released from federal custody. She declined to comment on why the case is sealed.

Lawrence F. Stengel, who served 14 years as a U.S. District Court judge — and his final year as chief judge — previously told LNP that court records are open unless there is a compelling reason to seal them. Examples of compelling reasons are the safety of a defendant or another person or the defendant may be cooperating, he said.

Lazar’s release date on the bureau of prison site shows Sept. 13. 

In the federal prison system, inmates generally serve about 85% of their sentence in a prison and the rest under community confinement.
If that is applicable in Lazar’s case, the time he’s spent incarcerated points to a sentence of 30 months.

Indiana Man Pleads Guilty to Carrying a Gun and Assaulting Law Enforcement Officers in Jan. 6 Capitol Breach

Firearm Was Loaded with Shotgun Shells and Hollow-Point Bullets

            WASHINGTON – An Indiana man pleaded guilty today to carrying a loaded gun on Capitol grounds and assaulting law enforcement officers during the breach of the U.S. Capitol on Jan. 6, 2021. His and others’ actions disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the presidential election.

            Mark Andrew Mazza, 57, of Shelbyville,  Indiana, pleaded guilty in the District of Columbia to assaulting, resisting, or impeding officers with a dangerous weapon and carrying a pistol without a license.

            According to court documents, Mazza brought a Taurus revolver, loaded with three shotgun shells and two hollow point bullets, into Washington, D.C., to the Ellipse, and then to the Capitol. Sometime on U.S. Capitol grounds before 2:45 p.m., Mazza lost possession of the revolver. Mazza illegally made his way to the Lower West Terrace and a tunnel area with doors leading into the Capitol Building. He joined in a collective effort of rioters to push through at least 20 officers who were defending the tunnel entrance.

At approximately 3:13 p.m., Mazza moved to the front of the tunnel line, next to the first set of doors. He held open one of the doors, and, as he did so, he allowed other rioters to attack officers with flag poles, batons, sticks and stolen law enforcement shields, and try force their way through the line of officers.  Thereafter, he took control of a baton from an officer’s hand and swung it overhead and downward to strike at officers in the tunnel entrance, hitting one officer in the arm. After striking at the officers with the baton, he continued his efforts to get past law enforcement officers and yelled, “This is our f---- house! We own this house!”

US Capitol riots: Texas man who stormed with gun gets longest prison term

Prosecutors said Guy Reffitt told fellow members of the Texas Three Percenters militia group that he planned to drag House Speaker Nancy Pelosi out of the Capitol building by her ankles, "with her head hitting every step on the way down," according to a court filing.
Reffitt's prison sentence — seven years and three months — is two years more than the previous longest prison sentence for a Capitol riot defendant.

But it's less than half the length of the 15-year prison term requested by a federal prosecutor, who called Reffitt a domestic terrorist and said he wanted to physically remove and replace members of Congress.

Reffitt was the first person to go on trial for the Jan. 6, 2021, attack, in which supporters of then-President Donald Trump halted the joint session of Congress for certifying Joe Biden's 2020 electoral victory.

Video: CIA deployed personnel during Jan 6 Capitol storming, records show

A government watchdog group announced Wednesday that it obtained new records showing that the Central Intelligence Agency (CIA) deployed personnel to Washington, D.C., during the Capitol Hill protest on January 6, 2021.

The ATF records obtained by Judicial Watch reveal a series of text messages labeled “January 7 Intel Chain.” The text messages include two different references to the CIA’s involvement on January 6. One of the text messages noted that “two CIA bomb techs” were assisting with “a pipe bomb scene on New Jersey and D ST SE.” Another text message said “several CIA dog teams” were “on standby.”

“First of all, why did it take Judicial Watch heavy lifting in federal court to get access to these documents after all these years?” Fitton asked. “Why didn’t the Pelosi January 6 Committee, even as corrupt as it was, not disclose the CIA involvement? What was the CIA involved for? Were they investigating foreign intelligence operations? Were they investigating American citizens? What else have they done related to January 6?”
