Fund the police? U.S. Police Have So Much Extra Gear They're Sending It to Ukraine :

Police departments around the U.S. are donating tactical gear to Ukraine, whose annual defense budget is smaller than the NYPD’s.

Law enforcement agencies in several states have all announced in recent days that they’re donating dozens of pieces of body armor, such as ballistic helmets and vests. Some of the departments and their respective local partners—one of which is a top defense contractor with U.S. and Ukrainian government contracts—say the donations will be distributed to Ukrainian citizens under siege by the Russian military.

State law enforcement agencies in Colorado and Vermont both announced Wednesday that they were donating defensive equipment to Ukraine. Vermont Gov. Phil Scott said the state’s policing agencies were “coordinating an effort to donate used and expired body-armor vests to military units in Ukraine,” and the Vermont State Police also encouraged members of the public to donate their own body armor as long as it’s rated Level III or higher by the Department of Justice’s research arm—capable of protecting against some rifle rounds, in other words.

The Colorado Department of Public Safety said it was donating more than 80 sets of body armor and 750 helmets, and that it was accepting donations from other law enforcement agencies in the state. “This is equipment that we are no longer able to use because it is beyond life cycle, or in some cases it may have been replaced or upgraded by some equipment that maybe better fits our needs or is safer,” Colorado DPS spokesperson Patricia Billinger told local station KARE9.

In Pennsylvania, the Falls Township Police Department, which has 53 sworn officers and is situated about 40 minutes north of Philadelphia, is sending 52 ballistic vests, including 15 “military-grade” vests capable of stopping rifle bullets, although they’re no longer under warranty, according to Falls Township police chief Nelson E. Whitney II.

“Perhaps militarization weakens the community relations necessary for effective policing.4 The public seems to believe that using tactical equipment, weapons, and other resources appears “more closely akin to military operations than domestic law enforcement.”5 Unfortunately, conversations regarding militarization usually have not included police agencies.”

“Nevertheless, the results also suggest that military-like displays may prove problematic for the police, primarily in appearance, rather than substance. For example, a sizable number of respondents agreed that some tactical characteristics of policing, such as the use of armored vehicles, military-style uniforms, and patrol rifles, contribute to a militarized appearance unacceptable for much of the public. Agencies may want to examine how to avoid such militaristic indicators while employing effective strategies.”

A long, powerful history: How we militarized the police :

Passage of the 1878 Posse Comitatus Act ended Reconstruction and barred federal military personnel from enforcing the laws. The Act does not apply to the National Guard, and over time they have been deployed repeatedly to keep the peace. A couple of examples: The 1894 Pullman strike saw 12,000 federal troops deployed to break up a workers’ strike. In 1957 Eisenhower nationalized the Arkansas National Guard to enforce integration in Little Rock.

militarization of police in America owes it origins to several events. First, reaction to the urban riots of the 1960s led to President Lyndon B. Johnson signing into law the Omnibus Crime Control and Safe Streets Act of 1968. The Act created the Law Enforcement Assistance Administration, which made available grants to local governments to develop and purchase military-type resources to suppress the riots. The money facilitated the development of SWAT and other heavily armored police forces which had developed in Philadelphia, Los Angeles, and other cities to counteract so-called black insurgency.

Second, President Richard M. Nixon’s declaration of the war on drugs and its reemphasis by President Ronald Reagan further enhanced the militarization of the police. It did so in its rhetoric — the war metaphor — sanctioning that a military-style response was needed to address drugs. But also underlying the war against drugs was a racial overtone — the urban riots of the 1960s and drug usage were often associated with blacks. This was seen later as punishment differentials between drugs such as crack and cocaine more heavily punished racial minorities than whites. American prisons and jails incarcerate far more people of color than whites for drugs.

The act aims to improve agency effectiveness and officer safety during drug interdiction and counterterrorism activities. After 9/11, Congress highlighted the need to transfer such equipment in support of homeland security.8

Police Brutality Law and Legal Definition :

Police brutality is a civil rights violation that occurs when a police officer acts with excessive force by using an amount of force with regards to a civilian that is more than necessary.

Excessive force by a law enforcement officers is a violation of a person's rights. Excessive force is not subject to a precise definition, but it is generally beyond the force a reasonable and prudent law enforcement officer would use under the circumstances.

Force should be used in only the minimum amount needed to achieve a legitimate purpose. Police brutality is a direct violation of the laws within the police force. The use of excessive force is also a direct violation of the Fifth and Fourteenth Amendments of the U.S Constitution regarding cruelty and protection of the laws.
