Before the 5th circuit has had an opportunity for an En Banc hearing on the matter The DOJ has already made an appeal to SCOTUS. There is a link to the appeal embedded in the text of this link.
"This case concerns a district court’s nationwide vacatur of
a regulation issued by the Bureau of Alcohol, Tobacco, Firearms,
and Explosives (ATF) to respond to the urgent public safety and
law enforcement crisis posed by the exponential rise of untraceable
firearms commonly called “ghost guns.”' The quoted text is directly from the appeal. Were I the the deciding factor in this matter I'd throw back at them for the simple reason that in Their statement they show a blatant disregard for the Separation of Powers inherent to the Constitution(The Chevron Deference I posted on yesterday) What BATFE determines to be "Policy" is not, in fact, Law, only Congress can make laws. My 2 cents.

They still don’t understand the Second Amendment. our founding fathers would not have tolerated any of this garbage.

When the riots erupted in Spokane WA during the Spring of 2020, a militia from Coeur d'Alene, Idaho showed up with AR's etc slung over their shoulders and peacefully walked the downtown streets. Many of the protesters let them know how threatened they felt etc, but because the militia was there several protesters called it a night and left. For some reason the rioters weren't afraid of the police even though they fired rubber bullets and tear gas at them.

I guess the rioters knew that the police response would be less than lethal. They didn't have a clue what the Folks from Idaho would do. "An Armed Society is a Polite Society"
