Can the VA refuse to treat a 100% service-connected veteran citing their case as "too complex," and also refuse to outsource them for care?

I have a pretty 'complicated' medical case but the VA continues to refuse at times to even consult with me despite internal VA referrals for the consults. They also refuse to refer me to anyone who possibly CAN help-- or the Mission Act options don't have any providers for the care needed within hours of me. Then they refuse to cover many of the meds that outside specialists suggest, costing me >$3,000 per year out-of-pocket. Is this OK at any level and would anyone have any suggestions for how to get the needed care? This way preceeded COVID-19 issues but continues despite it. I've been told the doctors won't even agree to a telehealth or video health consult at the VA across a few departments and programs. I'd already involved a senator's office a few years back and have made almost no progress. Help, please?

In addition to the White House, get your Congressman (not Senator) involved. They are more tuned in to help constituents. The VA does NOT want a CODEL (Congressional Delegation) visit.

Go to DAV headquarters in Washington DC and their leagal team will contact you for more info to get you on track just did that for wife 100% and 48 hours we were getting first call from VA to start resolution. They are your best bet!

Are they telling you more than it’s too complex or have they given you alternatives. The purpose of the mission act is to provide the care that VA is not able to. Is there a treatment plan currently in place for the issue. I have seen veterans request treatment that the VA provider didn’t agree with due to the treatment possibly causing more harm than good. There is also treatment that VA may not cover. So are they just saying it’s too complex? I used to be a Patient Advocate at VA.

Howdy. They can refuse you, but it needs to be with a referral, within one of their out-of-network providers through Veterans Choice Care. I work at a small Payer in MN , and we just took on the claims for the VA. There's also Community Care available through the VA. They CAN refuse the care, medications, and treatment that providers outside the network have recommended you. I would see if you qualify or can switch to Veterans Choice Care and/or partner through VA Community Care based on the state you live in. I would also write to your governor, and compare the local state healthcare statues with what the VA has, and always ask for documentation to be sent back to you ("Please send a written statement in explanation of your decision to deny benefits...") . I know this is extra work on your part and frustrating, but this is also what brings about change. This is why smaller community health plans, and even bigger insurers (Cigna, Blue Cross, United Healthcare) are all taking on VA claims at least to some extent in the states where we can work out an agreement.

Being 100% fine. Is your back (injury) situation part of your service connected disability rating? If it is then you should park yourself in front of your Service Reps State Office. Lean on them before some mealy mouth Senator or Congressmen. Do you really think in today's climate senators and congressmen are all hyped up about Veterans Care? Where did you hear one conversation mentioned by this administration or the house or senate with regards to upgrading and protecting Veterans? None!! That's what you heard!

The Veteran Service Organizations (VSO's) are not much help as they will tell you we can not get involved in healthcare issues! Find an aggressive and I mean an AGRESSIVE media outlet that wants to make ratings points! Especially a Veterans friendly reporter, such as a T.V. news reporter one who wants to get a primetime news story!

I would start with your VA hospital's Patient Advocate office, and if your issue is not resolved, then check out this link to determine how to proceed https://www.va.gov/health/rights/patientrights.asp. I don't know the specifics of your medical problems, but I would not give up on forcing the VA to address your condition.

The .gov means it’s official. Federal government websites often end in .gov or .mil. Before sharing sensitive information, make sure you're on a federal government site.

Important thing to remember about the VA, when a private insurance lets you die you stop paying them, when the VA lets you die they stop paying you.

I had the problem with the VA not being able to perform several complicated surgeries. This was due to their non competency in being able to successfully perform the surgeries. I was told and utilized my patient right. To have a second opinion, with subsequent treatment outside of the VA.
This is clearly spelled out and, cost or distance have no bearing on this.
I know this to be true. Because the VA gave me the option of finding a surgeon. Who as several states away. The hey reimbursed my travel expenses as well. What I didn’t agree with. As being denied my reservation at the Fisher house in the city I went to. Because I couldn’t have my service animal with me. That didn’t even make sense.

Call the White House Veterans Hotline at [login to see] . I have a really complex medical condition too. They've helped me in the past. I've gone to the Inspector General also and had luck with that option. I live in Tennessee and am currently waiting for them to finish my referral to the Mayo Clinic in Minnesota. You didn't mention if your condition is service connected. Mine is, I have systemic central nervous system poisoning from chemical exposure when I was on active duty. There is no treatment option so they are sending me to a research hospital. I had to fight but it does happen.

If it is a service related injury, then it should be 100% covered REGARDLESS of what the issue is. Even more so if it is from a deployment rather than non-deployed.
