Most businesses won't do the right thing unless they are forced to do so. Regulations are one way of making that happen. I do agree that when done wrong, they can be detrimental. However, they are often done wrong because congress has excused itself of the knowledge needed to do this correctly. Tie the requirements to industry standards and enforce something that can be updated and adjusted to meet current threats rather than codifying individual requirements in law.
In short, create the law so that it forces companies to comply with reasonable standards and then tie those reasonable standards to the experts like NIST.

Yeah this is classic garbage argument by Republicans that is anti-government regulation. He wants industry to have a say cause regulation will impact the market; I don't agree with that. Remember when private industry was hacked and they demanded government to do something about it in a manner they wouldn't have to spend money to do it themselves. Defending our critical infrastructure is a national security issue and private industry wanting to protect the market for capitalist interests is a subjective concern. Just saying.
