Did this take place recently in a school system that had students on site? If so it would be a matter of record is the student had turned in homework with perhaps students being witnesses to the act.
If o the other hand this is a remote incident where an assignment was sent electronically, that would be a different matter IMHO. Electronic transmissions don't always go where they are intended to go.
