Bowe Bergdahl Due Back in Court for a Pretrial Hearing

FORT BRAGG, N.C. —ArmySgt. Bowe Bergdahl is due back in court for a pretrial hearing on accusations that he endangered fellow service members by walking off his post in Afghanistan in 2009.
The Friday hearing will likely include further arguments on whether prosecutors should be allowed to admit evidence of injuries to service members who searched for Bergdahl.
The judge has also threatened to require testimony from government officials about the pace at which the defense is receiving classified evidence.
Bergdahl, who's from Hailey, Idaho, faces charges of desertion and misbehavior before the enemy, the latter of which carries a maximum penalty of life in prison. He was held captive for five years by the Taliban and its allies after he walked off his post.
His military trial is scheduled for April 2017.

How on earth is treason not one of the charges? Oh wait I forgot that the justice department is a political wing of the obama admin, and they need to provide top cover for the fact that obama traded 5 serious bad guys to get a traitor back. This turd needs to spend his entire life in a cage for his actions.

Because Treason is a Constitutionally defined crime, as opposed to UCMJ defined crime.
They have to use Art 99 (which they are) or Art 104 (which has a significantly higher bar).
As for trading to get him back. Until his CM is concluded he is still a soldier, and we don't leave people behind. He is still "our problem" and we "deal with him." We don't hand our problems off to others to deal with.

that is my point, I am pretty sure he hit all of the legal requirements for a treason charge.
Followed by, once he betrayed his country and his fellow soldiers, in word and in deed, he was no longer one of us. worse to trade 5 real bad guys to get him is a lot like paying a ransom, and 100% wrong. Locating him, and dropping in a team to recapture him, that is legit, trading 5 high value enemy prisoners is way too far.

Frankly I am tired of seeing or hearing about the trials and tribulations of Bowe Bergdahl SP5 Mark Kuzinski. I hope the trial gets underway soon and he is convicted of desertion and misbehavior before the enemy and we don't have to hear any more about him for at least a decade. I hope he will not get any book or movie royalties and will be forbidden from profiting from this episode.
